These terms and conditions govern the relationship between Dreamspot Africa Limited (referred to as " Dreamspot Africa Limited ", "we", "us", or "our") and the customer (referred to as "you" or "your") regarding the hire purchase and hiring services provided by the Company.

Dreamspot Africa Limited is a sales company and is not an affiliate, does not promote or advertise for a specific brand or ideology.

These terms and conditions constitute the entire agreement between you and Dreamspot Africa Limited regarding the hire purchase and hiring services, superseding any prior agreements or understandings.

By proceeding with a transaction with Dreamspot Africa Limited, you acknowledge that you have read, understood, and agreed to these terms and conditions.

Dreamspot does not sell or share your data collected through the registration form or agreement form.

The DreamSpot Africa Limited agreement form is a legal document that can be used in a court of law in case one party dishonors the agreement.

The DreamSpot Africa Limited registration form serves as your account information and must be filled to utmost sincerity and honesty. You are responsible for all the information you submit through/with this form.

The value of goods / product(s) we sell is equal to the downpayment price of the product plus the total of all the installments of the same products. The total installments will be installment price multiplied by duration of the same.

Dreamspot Africa Limited offers hire purchase and hiring services for different types of goods as revealed in our marketplaces both online (using our website social channels) or offline (using brochures or advertisement booklets).

DreamSpot Africa limited will always indicate the nature of goods on sale (whether new or used) and it is your responsibility to acknowledge and prepare in whatever manner the risks that may come with a specific nature of goods. E.g., a second-hand machine may need some maintenance from the new owner/user depending on the maintenance routine of the previous owner.

The availability of products and services in our catalogue is subject to change without prior notice.

Dreamspot Africa Limited will always indicate whether each and every product is subject to after sale services like warranty or free maintenance. The information on a particular product will not be applicable to another product. Each product will have its own terms which we will state clearly before an agreement is initiated with you.

You are considered to have defaulted on a deal /agreement with us if you miss 2 consecutive months of monthly installments, 3 consecutive weeks of weekly installments and 7 consecutive days of daily installments.

DreamSpot Africa Limited expects a customer to pay in full the downpayment on the day of initiating the deal and pay the installments on the respective due date without fail or delay.

If you default on payments, DreamSpot Africa Limited will consider that a termination of agreement and reposes the goods/product, do a valuation of the goods/product, and you will be refunded any balance amount after we deduct the depreciated value of the product from your accumulated payments as per the time of default.

For example, and context; if you buy a product worth 10,000 shillings, and you default on the deal having paid 7,000 shillings, we will reposses the product, do a valuation of the product, and let’s assume for example we find the product to be worth 8,000 shillings at the time of your default, we will deduct 2000 (amount of value you have depreciated the product) and refund you the balance of 5000 shillings from your accumulated payments. Apart from this, Dreamspot Africa Limited will not deduct any other cost upon default of the agreement.

Dreamspot Africa Limited has the responsibility and mandate to look for you and make you pay your dues in whichever legal way applicable in case of a default in your installment’s payment.

If you default on installment(s), you will have an option to pay the current installment (as per the specific time of default) plus all the previous installments you have defaulted to salvage the agreement. Failure to do this within our specified default timelines, you will be classified a defaulter and necessary action (repossession) will be taken against you.

Ownership of the sold product(s) under hire purchase model remains with Dreamspot Africa Limited until full payment (by measure of all installments plus downpayment) has been received from you.

You will not to sell, transfer, or modify the product(s) you have bought from us on hire purchase if you have not completed paying for them fully, unless if you obtain a letter from us with consent to proceed with the same.

Ownership of the hired product(s) remains with Dreamspot Africa Limited. You shall not to sell, transfer, or modify the product(s) you have hired from us without prior written consent from Dreamspot Africa Limited.

When you hire goods from Dreamspot Africa limited, we expect that the responsibility of the goods lies with you and the you will be liable if you lose, destroy or modify the goods in any way. If you hire goods and destroy them or lose them or modify them in any way, we will expect that you keep the goods and repay Dreamspot Africa Limited the full value of the goods /product.

Any damage/alteration caused by negligence or misuse of goods obtained by hire from us may incur additional charges.

You are responsible for good maintenance and repairs of goods/products bought from Dreamspot Africa Limited in hire purchase from the day of sealing the agreement to the day you finish paying fully for the goods/product.

The hire purchase or hire agreement may be terminated by either party with prior written notice.

The terminating party (between you and Dreamspot Africa Limited) will be considered the defaulter of the deal and will bear in full the consequences and costs of defaulting as outlined in earlier statements on this document.

If Dreamspot Africa Limited defaults on a deal/agreement, we will repay in full the accumulated total amount you have paid as downpayment and installments and reposes the goods if applicable.

If you default on a deal / agreement, DreamSpot Africa Limited will consider that a termination of the deal / agreement and reposes the goods/product, do a valuation of the goods/product, and you will be refunded any balance amount after we deduct the depreciated value of the product from your accumulated payments as per the time of default. You can see an example and context of this from the payment terms outlined earlier in this document.

Incase of non-existence of any of the party under the agreement for whatever reason, the agreement/deal will be considered terminated and the non-existence party will be terminator.

In case of your non-existence, the goods/product will be repossessed by Dreamspot Africa Limited and the indicated next of king in the registration document will be refunded as per our default refunding terms as outlined earlier in this document.

Dreamspot Africa Limited shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.

Dreamspot Africa Limited shall not be liable for any intentional or mistaken ignorance on this document.

Dreamspot Africa Limited shall not be liable for any consequences that may arise from you not reading and understanding this document or misinterpretation of the same.

Dreamspot Africa Limited reserves the right to amend these terms and conditions at any time.

Any changes will be communicated to you through an updated document. (Either online, offline or both).
